Mayor Nicholson opened the regular meeting at 7:30PM,
with the Pledge of Allegiance.
Public Hearing 7:40PM
Mayor
Nicholson opened the Public Hearing duly advertised in the May 6, 2010 issue of
the Port Washington News, to consider Bill No.1 of 2010, a proposed Local Law
clarifying the continued exemption of the Village of Baxter Estates from the
Village’s own local laws and regulations.
A
verbatim transcript of this public hearing is annexed to and incorporated into
these minutes.
On
motion of Trustee Comer, seconded by Trustee Peckelis, it was unanimously
RESOLVED to close the public hearing.
On
motion of Trustee Comer, seconded by Trustee Peckelis, it was unanimously
RESOLVED that Bill No. 1 of 2010 be adopted as Local Law No. 1 of 2010.

Treasurer
A. Abstract of Vouchers
On motion of
Trustee Comer, seconded by Trustee Baldwin, it was unanimously RESOLVED that
the Audited Vouchers dated June 3, 2010 for the General Fund totaling $ 25,182.31
be and hereby are approved as prepared by Treasurer Tuck.
B. Tax reduction
On motion of
Trustee Comer, seconded by Trustee Baldwin, it was unanimously RESOLVED to
approve the settlement negotiated
by Attorney Bradley for the tax reduction for Dejana properties Sec: 5 Blk: 33
Lots 128,26,27 & Sec:5
Blk: 4-1, Lots 101-102.

New Business
A. Bond Financing
Bill Jackson of
Hawkins and Delafield discussed the requirements for the Village about Bond Security and Taxing Ability.
B. Janet Demelas-52 Sandy Hollow Road
Janet Demelas
discussed ownership of land abutting the back of her property. She requested
that the Village determine who the owners were as various trees were in dire
need of attention. Deputy Mayor Comer
will address the issue.
C. Storm water report
Trustee Comer
reported that the annual storm water report had been signed by Mayor Nicholson
and submitted on time to the NY State Department of Environmental Conservation.
D. Transfer of Funds-Resolution to hold a Public Hearing
On
motion of Trustee Comer, seconded by Trustee Peckelis, it was unanimously
RESOLVED to hold a public hearing on July 1, 2010 at the new Village Hall, 315
Main Street, at 7:30pm to consider a transfer of $30,000.00 from the Village’s
Highway Snow Removal and Road Repair Reserve Fund to the Village’s Land and
Building Capital Reserve Fund.
E. Transfer of Funds
On motion of
Trustee Comer, seconded by Trustee Baldwin, it was unanimously RESOLVED to
transfer $2,000.00 from the General Reserve Fund to the Checking Fund.

Old Business
A. Hillside Avenue storm water drainage
Trustee Baldwin
reported that he had spoken with the Charles Vachris engineer, of Vachris
Engineering. P.C.
Executive Session 10:50pm
On motion of Trustee Comer, seconded by
Trustee Baldwin, it was unanimously RESOLVED to enter into Executive Session to
address potential litigation.
At 11:30pm, Trustee Comer stated that
Executive Session had concluded and that no action had been taken by the Board
in Executive Session.
There being no further business before the
Board, on motion of Trustee Peckelis, seconded by Trustee Comer, it was
unanimously RESOLVED that the meeting be and hereby is closed at 11:40pm.
